TERMS AND CONDITIONS OF LEGO® “BUILD A PLAYFUL HOLIDAY” SOCIAL MEDIA CONTEST (The “Contest”)
1. Contest
(a) “LEGO® Build A Playful Holiday” (the “Contest”) is a digital competition promoting the different ways people can celebrate the holiday season.
(b) The Contest is organised by LEGO Trading (Malaysia) Sdn. Bhd. (“LEGO Malaysia”) and managed by GOODSTUPH Private Limited (“GOODSTUPH”).
2. Eligibility
(a) The Contest is open to any individual who fulfil the following conditions (collectively the “Participants” and each a “Participant”):
(i) a Participant must be a Malaysia Citizen, Permanent Resident or Long-Term Pass Holder (including student pass or dependent pass) aged 18 years and above and residing in Malaysia; and
(ii) a Participant must not be an employee of LEGO Malaysia, any of its affiliates or any of its advertising agencies, an employee of GOODSTUPH or any of its affiliates, an immediate family member of any such employee, or anyone else connected with the Contest.
(b) GOODSTUPH reserves the sole and absolute right to assess and determine the eligibility of each Participant, and may require such information and documents as it considers necessary for the purposes of verifying the eligibility of an entry.
(c) GOODSTUPH also reserves the right to disqualify any Participant without assigning any reason whatsoever.
3. Contest Period
The Contest will take place from 18 November 2022 (00:00) to 1 December 2022 (23:59) both dates inclusive (the “Contest Period”). Any submission after the Contest Period shall be disqualified and rejected automatically.
4. Contest Mechanics
(a) The Contest will be conducted via Facebook under the contest hashtag #BuildAPlayfulHoliday.
(b) To enter a submission for the Contest, a Participant must:
(i) Leave a comment on the Contest Announcement post posted on 18 November 2022 on LEGO Malaysia’s Facebook page (https://www.facebook.com/LEGOMalaysia.official/)
(ii) The comment shall describe the Participant's creative idea of a perfect playful holiday
(iii) The comment shall be expressed in emojis only
(c) A Participant may edit/add to the submission posts at any point during the Contest Period. Upon the expiry of the Contest Period, no further additions will be accepted.
(d) Any submission not completed in accordance with these terms and conditions will be invalid and disqualified by GOODSTUPH.
5. Selection of Winners
(a) Out of all eligible Participants whose submissions qualify, 3x Participants with the most creative answer on Facebook as at 1 December 2022 (23:59) will be selected by LEGO Malaysia in its sole and absolute discretion (collectively the “Winners” and each a “Winner”).
(b) All decisions made by LEGO Malaysia in relation to the selection of Winners shall be final, conclusive and binding on all Participants and non-negotiable.
(c) The Winners will be contacted via social media direct message by GOODSTUPH no later than 10 working days after the end of the Contest Period. A Winner may be required by GOODSTUPH to verify his/her age and/or identity.
(d) The award of a Prize is subject to acceptance by the Winner. If a Winner cannot be contacted or does not respond to GOODSTUPH within 5 working days of GOODSTUPH’s direct message, or fails to provide the required verification(s), the Winner is deemed to have waived his/her right to the Prize. LEGO Malaysia has the right to select a supplementary Winner at its sole and absolute discretion. All decisions of LEGO Malaysia in this regard are final and binding on all Participants.
6. Prizes and Conditions on the Prizes
(a) 3x Winners will be determined by LEGO Malaysia based on the following criteria:
(i) Quality of their submission (most creative)
(b) Each Winner is eligible to win only one (1) prize comprising of one (1) playset from the LEGO playset list below, to be determined by LEGO Malaysia at its sole and absolute discretion:
(i) LEGO® City Police Station
(ii) LEGO®️ Disney Princess Ultimate Adventure Castle
(iii) LEGO®️ DUPLO®️ Wild Animals of Asia
(b) All Prizes will be sent via LACONIX ASIA (“Courier”) upon verification and provision of necessary information for delivery. Neither GOODSTUPH nor LEGO Malaysia shall be liable for the non-receipt of the prizes.
(c) GOODSTUPH reserves its sole and absolute discretion to replace and substitute any and all the Prizes with any other prizes of equivalent or similar values, at any time without prior notice. GOODSTUPH accepts no responsibility whatsoever for any variation and substitution of the Prizes and its values.
(d) All Prizes are not transferable and are not exchangeable for cash, credit, or other items in part or in full. GOODSTUPH shall not be responsible for any Prize in any event of loss, theft, damage etc after it has been delivered to a Winner.
7. General
(a) By participating in the Contest, each Participant:
(i) warrants and represents the truth and accuracy of all information and documents submitted to GOODSTUPH in relation to the Contest;
(ii) warrants and represents that all elements contained in the submission:
(A) are and/or will be original to the Participant and fully cleared for use as contemplated for the Contest;
(B) do and will not, in any way, violate or breach any of the terms of any other agreement the Participant may be a party to;
(C) are not unlawful, harmful, threatening, abusive, invasive of another’s privacy, harassing, defamatory, slanderous, tortious, vulgar, obscene, hateful, racist or otherwise offensive or objectionable to any other person or entity;
(D) do not infringe or violate any copyright, trademark or other right (including the full spectrum of intellectual property rights), or contain any matter the publication or sale of which will violate any law, including federal or state statute or regulation; and
(E) shall not require GOODSTUPH to pay or incur any sums to any person or entity as a result of GOODSTUPH’s use or exploitation of the same;
(iii) unconditionally and irrevocably grants LEGO Malaysia and its group of companies an exclusive right, and perpetual, worldwide, royalty-free, transferable license to post, display, publish, use, adapt, edit, and/or modify the material(s) uploaded in accordance with paragraph 4(b) above to the public in all media including social media for promotional and marketing purposes in connection with the Contest only without further reference, compensation or payment to the Participants; and
(iv) agrees to provide his/her personal data and/or information to GOODSTUPH for verification, contact, products delivery and/or services in connection with the Contest only. All Participants understand and agree that GOODSTUPH may in connection with the Contest only collect, use and/or disclose such personal data and/or information provided for promotional and marketing activities via email, push notification and/or SMS, administration, feedback, surveys, market research, delivery of products by GOODSTUPH service providers or independent contractors, individualised services and/or disclose them to LEGO Malaysia-related corporations in accordance with the Personal Data Protection Act 2012. The Participant further agrees to the Contest Privacy Policy set out at https://www.lego.com/en-my/legal/notices-and-policies/privacy-policy.
(b) Any of the Participant’s personal data and/or information collected for the purposes of the Contest will not be retained by GOODSTUPH or LEGO Malaysia beyond the completion of the Contest (the “Retention Period”). A Participant may withdraw consent to the collection, use and/or disclosure of the Participant’s personal data and/or information at any time during the Retention Period by notice in writing to GOODSTUPH data protection officer(s) at lego@goodstuph.org. Any withdrawal of consent by a Participant to any collection, use or disclosure of such personal data and/or information will amount to an immediate withdrawal of the Participant’s submission for the Contest.
(c) In accepting the Prize, each Winner:
(i) agrees to be featured in any LEGO Malaysia collateral for publicity and announcement purposes in connection with the Contest only;
(ii) acknowledges that LEGO Malaysia may post news or updates about the Contest and the Winners on its website and through other social media websites. However, LEGO Malaysia is under no obligation to post content about the Winner and makes no representation and provides no guarantee as to when such content may be generated or published; and
(iii) acknowledges and understands that he/she is responsible for any tax payable in respect of the Prize.
(d) All personal costs and/or any other costs, fees and/or related expenses that are incurred or to be incurred to participate in the Contest or after the Contest are the sole responsibility of the Participants.
(e) The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, Twitter or any other social media network.
(f) LEGO Malaysia reserves its rights to amend, vary, modify, change, suspend, cancel, extend, remove or delete any terms and conditions of the Contest at any time without prior notice and in any dispute arising out of this Contest, the decision made by LEGO Malaysia shall be final and binding onto the parties of the dispute. LEGO Malaysia and GOODSTUPH shall not be held liable to compensate and/or indemnify any Participant for any loss and damages in any manner whatsoever in connection with the Contest directly and/or indirectly.
(g) The laws of Malaysia shall govern the terms and conditions of the Contest. The Participants agree to submit to the non-exclusive jurisdiction of the courts of Malaysia for all matters arising from or in relation to the Contest.
